Access to Information on the Environment (AIE)

The European Communities (Access to Information on the Environment) Regulations 2007-2018 (AIE Regulations) give you the right to access information held by NMBI about environmental issues.  

The AIE Regulations allow you access to a wide range of information. You can make a request to NMBI for information in written, visual, electronic or any other material form from any of the following categories:

  • The state of the elements of the environment. This includes, but is not limited to, air and atmosphere, water, soil, land, landscape and natural sites including wetlands, coastal and marine areas, biological diversity and its components including genetically modified organisms and the interaction among these elements. 
  • Factors such as substances, energy, noise, radiation or waste, including radioactive waste, emissions, discharges and other releases into the environment, affecting or likely to affect the elements of the environment. 
  • Measures (including administrative measures) such as policies, legislation, plans, programmes, environmental agreements, and activities affecting or likely to affect the elements and factors referred to above, as well as measures or activities designed to protect those elements. 
  • Cost-benefit and other economic analyses and assumptions used for the above measures and activities. 
  • The state of human health and safety, including the contamination of the food chain, where relevant, conditions of human life, cultural sites and built structures that may be affected by the elements of the environment. 
  • Reports on the implementation of environmental legislation.

Making an application under the Access to Information on the Environment (AIE) Regulations?

Your request for access to records under the AIE Regulations must be in writing and addressed to the FOI Officer. In making your request, you are asked to:

  • state that the application is being made under the AIE Regulations
  • provide as much detail as possible about the information you are requesting
  • provide your contact details
  • specify the form and manner of access desired.

These requests are for non-personal information only.

Normally you will be notified of the decision on your request within one month of its receipt. Where, due to the complexity or volume of information required, we are unable to respond within the one month timeframe, we are required to write to the applicant within the month, indicating when a response will issue. This date should not be more than two months from the receipt of the original request. 

Appeal to the Internal Reviewer

If you feel aggrieved regarding a decision of NMBI to limit or refuse access under the AIE Regulations 2007-2014, then you have the right of appeal to the Internal Reviewer. Please contact:

Appeal to Commissioner for Environmental Information

If you are unhappy with the outcome of the internal review, you may ask the Office of the Commissioner for Environmental Information (OCEI) to review the matter. You should request an appeal to the OCEI within one month of receiving the decision of the internal review by writing to:

Fees

A request does not require payment of an upfront fee, however, a public authority may charge a reasonable fee to certain applications received, as provided for in S.I. 133 of 2007 and, S.I. No. 662 of 2011.
