Legal Statement

This website is provided by Nursing and Midwifery Board of Ireland (“NMBI”, “we”, “us” or “our”) of 18-20 Carysfort Avenue, Blackrock, Co. Dublin, Ireland.

This legal statement as well as our Privacy Statement tells you the terms of use on which you may make use of our website www.NMBI.ie (including without limitation, all written communications, emails and by telephone) (collectively known as “our website”) whether as a guest or a member of NMBI. Please read this statement carefully before you start to use our website or communicate with us.  By using our website or communicating with us, you indicate that you accept and agree to be bound by this legal statement as well as our Privacy Statement. If you do not agree with this legal statement, you must not use our website.  

Information about the NMBI

NMBI is the independent, statutory organisation which regulates the nursing and midwifery professions in Ireland. Our purpose is to protect the public and to ensure the integrity of nursing and midwifery practices. We set the standards for the education, registration and professional conduct of nurses and midwives.  We also advise on how nurses and midwives should provide care to patients, their families and society. Further information on NMBI and its functions can be found in the What we do section. 

Accessing our website & Registers 

To certain sections of our website, you must be a “member” of NMBI and allocated initial login details which you will use to set up an account and create a username and password.  “Members” are classified as nurses/midwives on NMBI’s Register of Nurses and Midwives, applicants who apply to NMBI to join the Register and students (or candidates as they are referred to)  of approved nursing/midwifery courses in Ireland’s higher education institutions (HEIs) which lead to registration with NMBI.
 
In relation to the Register of Nurses and Midwives as well as the Candidate Register (collectively the “Registers”), no representations are made as to its accuracy nor shall we incur any liability from the user’s reliance upon it or from the inclusion in it or omission from it of any individual. NMBI Members

By registering with the NMBI (whether online or manually), you are warranting that all documentation and/or information provided by you during the registration process (and any notification of change of such information) are true and correct and you agree to maintain and notify us of updates to this information as required to enable us to keep it current, complete and accurate.  We process information about you in accordance with our Privacy Statement and by providing such information and/or by using our website, you consent to such processing. 

Each personal account may only be accessed by a NMBI member user using the initial details provided, thereafter the username and password selected (hereinafter “Login Details”).  Login details should be kept secret to uphold and maintain the privacy of personal accounts.  Your account is at risk if you let someone else use your login details.  However, if you decide to tell someone your login details, they become your nominee and are subject to this legal statement. You will be solely responsible for the use and/or security of your login details and your account as well as for all activities that occur under your account. 

You agree to immediately notify us of any unauthorised use of your account or of any breach of confidentiality/security.  We will not be liable for any loss or damage arising from your failure to keep your login details or account confidential, secure and for any and all unauthorised use. We reserve the right to freeze any account pending investigation of inappropriate and/or unauthorised use or breach of confidentiality/security.

Intellectual Property & Re-use of Public Sector Information 

We are the owner or the licensee of all intellectual property rights (including but not limited to trade marks, service marks, trade names, copyright, future copyright, registered or unregistered design rights or applications for any of the foregoing; trade and/or business names; know-how; database rights and rights granted under licenses and consents; goodwill and reputation) in and relating to our website and in the material published on it (including but not limited to information, content, materials, programs, designs, graphics, texts, layouts, screen icons, GUIs).
 
We comply with the regulations on the re-use of public sector information as provided for under SI No. 279 of 2005. We retain copyright over all information featured on our website unless otherwise indicated. We encourage the re-use of the information provided on our website. Any subsequent re-use of information and documents obtained from our website may be reproduced and/or re-used subject to the latest PSI Licence available at www.psi.gov.ie. Permission to reproduce information from our website does not extend to any material on this site which may the property of a third party. Authorisation to reproduce such material may be obtained from the copyright holders concerned. We are not liable for any loss or liability associated with the re-use of information contained on our website. 

Acceptable Use

You are responsible for your use of our website.  You may only use our website for lawful purposes. You may not:

  6. Impersonate any person or use a name that you are not legally authorised to use;
  7. Introduce viruses or any other code, files or programs which interrupt, destroy or limit the functionality of any computer software, hardware or equipment belonging to us;
  8. Engage in any conduct that constitutes a criminal offence or that gives rise to civil liability as well as encourages such conduct;
  9. Engage in any conduct that violates this legal statement, our Privacy Statement or any policy on our website; or interferes with the use and enjoyment of our website by others;
  10. Use our website or service in contravention of any applicable law nor permit or assist others to do so; or
  11. Fail or refuse to keep confidential or secret information, content and material on our website.

You may not use our website in any manner that (or is likely to) damage, disable, overburden, or impair the servers or networks. You may not attempt to gain unauthorised access to our website, members accounts, computer systems or networks, through hacking, password mining or any other means and may not attack our website via a denial-of-service attack or a distributed denial-of service attack.  We may take any remedy (including legal and technical) to prevent any breach or to enforce this legal statement including without limitation immediately withdrawing your right to use our website (whether temporarily or permanently) or reporting any breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. We exclude liability for actions taken in response to breaches of this legal statement. The responses described in this statement are not limited and we may take any other action we deem reasonably appropriate. 

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material owing to your use of our website or to your downloading of any material posted on it, or on any website linked to it. 

Third Party Content and Links from our Website

Our website may contain information, content and materials provided by third parties as well as links to third party websites.  We do not endorse or approve such content on our website or on third party websites.  We are not responsible for and do not make any representations regarding such content or the accuracy of content provided on our website by third parties and/or contained on third party websites.  If you rely on such content and decide to access such websites, you do so at your own risk.

We reserve the right to edit, modify, alter or remove all or any information, content and/or material or shut down all or any part of our website for whatever reason including any information, content and/or material that is unlawful, misleading, unsuitable, unauthorised or that breach this legal statement and if appropriate, to inform the relevant authorities or relevant third parties. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our website constitutes a violation of their intellectual property rights, or of their right to privacy. You may be asked to input information about yourself on different pages of our website.  We will not use the information you provide for any purpose other than that stated at each location where such information is requested.  Such use of the information will be governed by our Privacy Statement.  

Waiver

Our failure at any time to enforce any provisions of this legal statement shall in no way affect its right thereafter to do so.  Any waiver by us of any breach of any term, provision or condition shall not be taken or held to be a waiver of any subsequent breach of any such term, provision or condition or to be a waiver of the term, provision or condition itself.  

Governing Law

This legal statement shall be governed and construed under the laws of Ireland. You and the NMBI both agree to submit to the exclusive jurisdiction of the courts of Ireland to settle any disputes which may arise from or in connection with this legal statement.

Severability

If any court of competent jurisdiction decides that any part, term or provision of this legal statement is invalid or otherwise unenforceable, such provision shall be severed and deleted from this legal statement and the remainder of the legal statement shall continue to have force and effect.

Variations 

We may revise this legal statement at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you.
